THE FIJI COPYRIGHT ACT (1999) AND COPYING FOR ACADEMIC AND EDUCATIONAL PURPOSES

IMPLICATIONS FOR TEACHING AND RESEARCH

Teaching

• A member of the teaching staff may only make one copy of an article from one issue of a journal. Multiple copies for teaching purposes are not permitted without copyright clearance from a licensing agency
• A member of the teaching staff may only copy 10% of a book
  e.g. 15 pages of a 150 page book or one chapter whichever is the less
• Copying in a dramatic, musical or artistic work is not infringed by its being copied in the course of instruction  or of preparation for instruction provided the copying -
  • is done by a person giving or receiving instruction; and
  • is not by means of a reprographic process*
• Copying of a sound recording, audio work or audio-visual soundtrack, broadcast or cable programme is permissible 'provided the copying is done by the person giving or receiving instruction.'
• The Library may hold in the Reserve Collection one copy of the journal article or chapter of a book or 10% of a book whichever is the less.
• Works in the public domain, may be copied with due acknowledgement. Important that this material is clearly 'public domain' by definition, not personal interpretation.

Online Access

• The above applies. At any one time, throughout the University, only one copy of an article or chapter of a book may be accessible online therefore permitting access via one server only.

Research

• The individual researcher can make copies of works solely for research purposes. Due acknowledgment must be made.

Copyright Licensing Agency

• For second copies or more, copyright clearance is obtained from a licensing agency and the appropriate fee paid.  The Library is currently negotiating with CAL Australia pending the establishment of an agency for the South Pacific
